The present General Terms and Conditions apply to the use of this website as well as to the purchase of any products/services through this website; they define the terms and conditions of all visits and use of both our website and our web-store, and determine the purchase contract concluded between the two parties for any purchase order made through this website.

You are requested to read carefully these Terms and Conditions and make sure you consent to them before entering our web-store. In case you do not agree to them, you are advised to leave the present website. However, any action such as browsing, signing in our newsletter, or purchasing any of our products; will signify your full consent to the present Terms.

1) What does Ergosimansi.gr provide?

Ergosimansi.gr is an online store that has been created to exhibit, promote and retail the products of its suppliers in such a way as to offer every visitor the possibility to choose through a wide range of footwear and clothing products and purchase any product at highly attractive prices. The company reserves every right to choose the products that will be exhibited on the website Ergosimansi.gr, as well as to replace or/and withdraw any of them, at any time, with no reason and with no previous notification.

In addition, both the company’s price policy and its retail promotion methods, through special offers or/and discount, are solely determined by the company itself; and they can be modified at any time with no previous notification.

2) Reception and fulfillment of an order

Ergosimansi.gr has established an effective collaboration with various suppliers, importers and manufacturers, from Greece as well as other countries, in order to provide you with a wide range of products at the most attractive prices in the market.

There is a certain process, which is described in detail below, that needs to be followed by any visitor who wishes to place an order, and that is mainly because occasionally – for reasons we cannot be held accountable for – a product that appears to be available for purchase may not be eventually available or due for delivery within the time limit that is displayed in Ergosimansi.gr. This can happen because there are physical stores in the same company. Thus, in order for you to be totally aware of your order’s progress and fully protected against any potential risks, your order can be completed through the following steps:

a) Sending order request

You are requested to sign in as a user on Ergosimansi.gr before placing your initial order, so as to secure an easier and more convenient transaction on our website.

Initiate the process of sending the order request by following the suggested steps. Fill in all the information required in the order format.
An automated message with the information of your order as this has been received from our website will be sent to your registered e-mail.

Before sending us an order request, you should accept the terms of use, since they define every transaction you make with our company.

Please be aware that our company is entitled to express any reservations regarding the availability of the products included in your order request, given the fact that at that time the process of your request has not been yet initiated.

Finally, we would like to inform you that our company adopts a strict policy regarding the protection of your personal data, and it is only with your full consent (which is granted through the order format) that it is gathered and processed in a proper and totally secure way.

b) Order request process

At this stage, our company verifies the availability of all the products that are included in your order request.

In case every product included in your order request can be available within the time limit projected on our website, a confirmation e-mail consisting of all your order’s information will be sent to the web address you have registered. Afterwards, the products will be sent based on the delivery schedule of the courier company we collaborate with.
In case one or more of the products included in your order request is not available or/and cannot be delivered within the time limit projected on our website, a competent member of our staff will contact you by phone or e-mail in order to inform you about the limited availability.
In case, for any reason, none of the communication methods mentioned above can be established within 10 days since the date of your order request, the request will be automatically canceled and a new one should be resent to us.

c) Phone orders

If you choose to do your order by phone and not through the site's form it is a prerequisite for you to know our online store's terms and conditions located here.

By choosing to put an order by phone, mean's that you automatically and fully accept our online store's terms and conditions through all the phone order process.

3) Order payment

In order to pay for the products you may be interested in buying, you can choose between the various payment methods suggested.

First, you choose the payment method that you consider most satisfying. Then, you select that specific payment method from your order format and, finally, you fill in the personal information required.

We would like to inform you that the shipping cost inside Greece is free of charge for all orders, provided their total cost is over 150€. For orders equal or below 150€, the shipping cost depend on the weight of the order.

We would like to remind you that our company adopts a strict policy regarding the protection of your personal data, and it is only with your full consent (which is granted through the order format) that it is gathered and processed in a proper and totally secure way. As regards to the payments by a credit card, our company, in collaboration with Piraeus Bank, has taken every precautionary measure as to secure the highest level of protection during your electronic transactions. Our company uses the SSL protocol that provides maximum security in communication between electronic payment systems.

4) Payment methods

a) Cash on Delivery (Freight Collect)

Your order will be dispatched to the mailing address indicated on your order form and payment will be due upon delivery. When the package with your order is delivered at your door by the associate courier agent, full cash payment of order is made. It is evident that the customer is expected to accept delivery of goods only if packaging is intact (i.e. not damaged or torn). Hence, the customer may not open the package before full payment is made. Finally, there is no charge for delivery of orders in Greece exceeding €150. Orders of products worth €150 or less, the shipping cost depend on the weight of the order.

b) Credit/Debit Card Payments on Orders

Orders can be made by card. We presently accept Visa, Mastercard, American Express and Maestro, while in the future we will include the Diners card. Ergosimansi.gr has signed a customer data security and confidentiality policy agreement with Piraeus Bank in order to maximize security on all electronic transactions![ep2]

Customers can feel confident that Piraeus Bank deploy the most updated and intelligent systems internationally, having secured their websites with the Secure Hash Algorithm 2 Certification. Hence, in order that your order may be processed and payment made by card, your computer’s operating system must not be supported by one of the following systems:

c) Bank Deposit Payment

​In this form of payment, full cost of order must be deposited to one of the following bank accounts. For bank deposit orders to be processed, proof of payment must accompany the order by way of a photograph/screenshot of the deposit slip emailed to info@ergosimansi.gr.

d) Payment by PayPal

5) Product delivery and delivery costs

At the time of the confirmation of your order, you will also be informed of the delivery time, which may vary based on the area you selected for your products to be sent to.

Your order will be sent to you directly from our company or a courier chosen exclusively by our company, during working days and hours (Monday - Wednesday - Saturday: 09:00 - 15:00 and Tuesday, Thursday and Friday: 09:00-14:30 and 17:30-21:00).

Based on the delivery schedule of the courier company we collaborate with, deliveries are made as follows:

in Ioannina, within 1-2 business days since your order has been recorded by our web-store
in county capitals within 2-3 business days from when your order is completed at our store
in other areas within 2-3 business days from when your order is completed at our store, except for remote locations that may be delivered within 4 business days.

Our company cannot be held liable for any delays caused by force majeure or any other incidents that cannot be controlled or predicted. For instance, our company is not responsible for any delays that occur in customs or any intermediate load-unload checkpoints, due to strikes by transportation-mean personnel or any other strikes that may affect the prompt supply of our warehouses, etc.

In the case of a potential delay, our company will make any necessary effort to contact you using the personal data you have previously registered, in order to notify you accordingly and agree with you upon a new delivery date or the delivery of a different product.

Despite the fact that our company goes to great lengths to respond adequately to your need for prompt notification regarding any potential limited availability, there is always the possibility that our suppliers encounter unexpected lack of availability even after the confirmation of your order. In such cases, our company will once again make every possible effort to establish contact using the personal information you have registered, in order to inform you properly and agree with you upon a new delivery date or the delivery of a different product or even the cancellation of your order with no further damages for both parties, as well as an interest-free refund of the amount of money you may have paid in advance within a reasonable time-period.

You can choose to pick up from our store in Ioannina when you complete your order. In this case, the products you ordered will be reserved for you for 3 business days and within this time you can come to pick up your parcel. At the end of the above timespace, your order will be canceled automatically. The address of the store is 3rd km of the National Road Ioannina - Athens, Ioannina. Our partner will contact you by phone for the day and time when your order is ready for pickup.

We would like to inform you that the shipping cost inside Greece is free of charge for all orders, provided their total cost is over 150€. For orders equal or below 150€, the shipping cost depend on the weight of the order.

6) Product returns - changes a) Return of goods and refund of payment

The customer is entitled to a return any products received within 14 calendar days and request a refund. Note that date of delivery refers to the date displayed on the courier company delivery receipt and returns will be accepted fourteen (14) days thereafter. The customer should contact our company strictly by telephone before making a change.

For goods returned within Greece (as with order changes) an additional charge of 7.90€ applies for the customer.
Return of goods from overseas locations carry an additional charge for the customer.
In any event, goods must be returned in the condition received by the customer - that is to say:

products must not be damaged and in their accompanying packaging
products must be in their factory packaging, including any cardboard boxes or plastic wrapping
products returned must include any documentation of purchase for example, receipts, invoices etc.
Returns of orders that meet the above criteria may be received by us for replacement once the customer contacts our customer service department, otherwise our company reserves the right not to accept returns.

Return of products is simple and can only occur after telephone arrangements are made on 26510 78469 or 26510 31469. In short, the procedure by which goods may be returned is as follows: Once the customer has contacted our offices, goods are returned in their packaging via the Speedex company at no extra charge. Upon receipt of returned goods, our staff examine the products to ensure the abovementioned criteria are met. New products are sent to the customer for which an additional cost of €7.90 is charged. Should another courier company be preferred by the customer, Ergosimansi.gr will not cover the cost of shipping products and will take no responsibility for possible delays in estimated time of receipt of goods via this courier service.

Note that products of the same value may be exchanged and that the additional cost mentioned above applies. In the event that the product you have chosen carries a lower or higher price that of the initial product returned, you will be issued a customer voucher equal to the difference in value. Cash refunds are not made by our company.

In the event of a return of goods following an in-store pickup, arrangements are to be made by phone and the new product is sent by our company to the customer via our associate courier at a charge of €7.90, equivalent to the shipping costs charged by the courier.

b) Return of faulty or damaged goods

In the event that proven liability lies with Ergosimansi.gr for the sale of faulty or poor quality goods, error in the delivery of products, invoicing error, poor handling and shipping of damaged goods, poor quality packaging etc., then Ergosimansi.gr will provide a full replacement or full refund of amount paid for the order and the cost of return shipping (whereby the full amount will be deposited in a bank account indicated by the customer).

Clear and detailed photographs of damaged or poor-quality goods must be emailed to info@ergosimansi.gr as proof of damage or poor condition for the relevant department to examine thoroughly before a refund or replacement can be arranged. If products are returned and the mentioned procedure is not followed, the customer will pay the full cost of return of goods, including any additional charges as our company reserve the right to refuse to accept returned goods. The terms of return remain as above.

c) Order cancellation and right of withdrawal

The customer may cancel an order when the following circumstances arise:

a) Before the order is dispatched: – Cancellations may be made via email to info@ergosimansi.gr or by telephoning 26510 78469 on weekdays Monday – Friday 9:00-15:00 and 18:00-21:00 & 26510 31469 on weekdays Monday – Friday 9:00-16:30. In the event that a cancellation occurs after the order is dispatched, the customer is charged €9.80, equivalent to the fee for shipping of products (€4.90) and their return to our premises (€4.90).
b) Customers are also entitled to withdraw fourteen (14) calendar days following receipt of goods. Understandably, the terms of returning faulty or damaged goods must apply for the customer to be entitled to cancel or withdraw.
Within fourteen (14) calendar days of receipt of order the customer is entitled to return products and receive a full refund of amount paid. Refunds are always based on initial price of goods, excluding €9.80 for shipping costs (€4.90 for dispatch and €4.90 for return of products, which is the amount that the customer would not have been charged had the order not been cancelled). Deposits of money refunded are made within fourteen (14) working days of receipt of returned order and only on condition that terms applying to return of damaged goods are met.

Please note that refunds are made only when the customer is entitled to right of withdrawal. In the event that an exchange of goods is arranged for products of lower value you are entitled to a discount voucher for the amount equal to the amount that remains, excluding the amount of €7.90 for shipping costs, as described in paragraph 6, «Product returns - changes».

 

7) Use – Operation - Content

Both the company and the consumer are bound to use and operate this website properly, based on good faith and business ethics.

Our company’s trading strategy and price policy are in full consonance with the terms regarding the protection of competition. Therefore, the prices of the products sold on Ergosimansi.gr may differ from those of similar products sold at any other stores, since our company proceeds to various special offers and other promotional actions at times we see it fit for our business goals to be achieved.

Our company reserves the right to alter the price of any product, at any time, with no reason and no previous notification.

8) Copyright and Trademarks

The content of Ergosimansi.gr, in its total, constitutes intellectual property of the company and is protected by the corresponding provisions of both domestic and international legislation, as well as the international conventions concerning intellectual property. For example, every article, any kind of archive, the signs/logos, the website’s layout, the software, every photo, and design, both commercial and financial data etc. are considered as such. The rights of third parties, such as associates, collaborating sectors etc., are not related to the company’s own rights. Total or partial copy, distribution, storing, reproduction, republishing, transfer, modification, alteration, or any other similar action of the aforementioned information is explicitly prohibited, unless the company has granted prior, clear and written consent. Any potential actions opposed to the prohibitions mentioned above may offend our company’s intellectual/industrial property rights. 9) Personal Information
